Terms and Conditions

Welcome to Bigwein. These Terms and Conditions (“Terms”) govern your access to and use of the Bigwein website, dashboards, services, features and related digital interfaces (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms.

1. Platform Role

Bigwein provides a digital marketplace that allows users to discover, list, advertise, search for and enquire about properties, rentals, commercial spaces, businesses for sale and related services. Unless expressly stated otherwise, Bigwein acts as a technology platform/intermediary and is not itself the owner, seller, lessor, buyer, broker, developer, builder or guarantor of any listing or transaction.

2. Eligibility and Accounts

• Provide accurate, current and complete information.
• Keep your login credentials secure.
• You are responsible for activity under your account.
• Where KYC or identity verification is required, access to listing or other features may remain restricted until approval.

3. User Roles

Features may vary for buyers, tenants, owners, sellers, builders, developers, business sellers and administrators. Access may depend on role, verification status, subscription or permissions.

4. Listings

Users who publish property or business listings are responsible for the accuracy, legality and completeness of ownership/authorization, pricing, location, dimensions, amenities, images, availability, approvals and all other representations.

Bigwein may review, reject, suspend or remove listings that are misleading, unlawful, duplicated, expired, reported or otherwise violate Platform rules.

5. Verification and Due Diligence

Any verification badge, KYC review or listing approval is intended to improve Platform quality and must not be treated as legal, title, financial, engineering or investment certification. Users must independently verify ownership, title, approvals, encumbrances, measurements, pricing, condition, counterparties and transaction documents before making payments or commitments.

6. Enquiries and Communications

When you submit an enquiry or contact request, relevant enquiry and contact information may be shared with the listing party so they can respond. Users must not use the Platform for spam, harassment, fraud or unrelated solicitation.

7. Payments and Subscriptions

Certain features may require subscription, promotion or other fees. Applicable pricing, taxes, inclusions and refund terms will be shown at purchase or in the relevant commercial terms. Payments may be handled by third-party payment processors.

8. Prohibited Use

• False, fraudulent, misleading or unauthorized listings.
• Impersonation or misuse of another person’s identity.
• Malware, attacks, security bypass or unauthorized access.
• Scraping or bulk extraction without authorization.
• Infringement of intellectual-property, privacy or legal rights.
• Money laundering, fraud or any unlawful activity.

9. User Content

You retain ownership of content you submit, while granting Bigwein the limited rights necessary to host, display, reproduce and promote that content for operating the Platform. You confirm that you have rights to all text, images, videos, documents and trademarks you upload.

10. Intellectual Property

The Bigwein name, branding, software, interfaces, databases, design and original Platform materials are owned by or licensed to Bigwein and protected by applicable law.

11. Third-Party Services

The Platform may integrate with maps, payment gateways, messaging tools, analytics, social login or other third-party services. Their own terms and privacy policies apply to those services.

12. Platform Availability

We aim to keep the Platform available and reliable but do not guarantee uninterrupted or error-free operation. Maintenance, upgrades, network issues, security incidents or events outside our reasonable control may affect availability.

13. Disclaimer

The Platform and listings are provided on an “as available” basis. To the maximum extent permitted by law, Bigwein does not guarantee the accuracy, authenticity, legality, quality or outcome of any listing, user or transaction.

14. Limitation of Liability

To the maximum extent permitted by law, Bigwein is not liable for indirect, incidental, consequential, punitive or loss-of-profit damages arising from use of the Platform, user-to-user dealings, inaccurate listings, third-party conduct or matters outside our reasonable control.

15. Indemnity

You agree to indemnify Bigwein and its officers, employees and service providers against claims, losses and costs arising from your misuse of the Platform, unlawful conduct, listings, content, breach of these Terms or infringement of third-party rights.

16. Suspension and Termination

Bigwein may suspend accounts, remove listings or restrict access where reasonably necessary for security, fraud prevention, legal compliance, policy enforcement or protection of users.

17. Privacy

Your use of the Platform is also governed by our Privacy Policy.

18. Changes

We may update these Terms from time to time. The revised version will be posted with an updated effective date.

19. Governing Law

These Terms are governed by the laws of India. Subject to applicable statutory and consumer rights, disputes shall be subject to the competent courts having jurisdiction over the registered place of business of the Platform operator.

20. Contact
